Tamil Businessman from Sri Lanka Granted Refugee Status

We act for a large number of Sri Lankan clients who are seeking protection in Australia. This is a summary of one of those cases.

Our client was arrested by Sri Lankan authorities in late 2009; he was (falsely) accused of involvement with the Liberation Tigers of Tamil Eelam (the LTTE, or ‘Tamil Tigers’). Our client was tortured, escaping only through by bribery. Even after his release, our client continued to be targeted; he was kidnapped, blindfolded and detained by the paramilitary Karuna Group, who continued to accuse him of supporting the LTTE. Fearing death, our client escaped from captivity, fleeing Sri Lanka shortly afterwards.

We advised and represented our client. We prepared submissions in his favour, comprising legal arguments and country information.

We dealt with doubts about our client’s credibility by providing detailed explanations for his conduct. We argued, based upon both Australian and Sri Lankan law, that our client’s account of his experiences should be accepted as credible; this argument was accepted.

We proved that his experiences in captivity were consistent with international observers’ accounts of the torture and mistreatment of Sri Lankan Tamils suspected of supporting the LTTE; this argument was accepted.

We argued, based on decisions of Australian courts and upon available country information, that our client would continue to face a real chance of harm in Sri Lanka if forced to return there; this argument was accepted.

Our client’s refugee claim was successful, and he was granted a protection visa. He is just one of the many asylum seekers from Sri Lanka who we have successfully represented in their quest to seek protection in Australia.
