Young Tamil Hindu man from Sri Lanka becomes refugee

In the course of our immigration law practice, we acted for a young Tamil Hindu man from Sri Lanka who claimed refugee status in Australia because he faced persecution from the Sri Lankan authorities due to his perceived support for the Liberation Tigers of Tamil Eelam (LTTE, also known as Tamil Tigers), the fact that he originated from a previously-LTTE-controlled area, his illegal departure from Sri Lanka, and his status as a failed asylum seeker.

Members of our client’s family, including our client himself, had been forcibly trained by the LTTE, and this was one of our client’s main reasons for our client’s claims for protection. Members of our client’s family, including our client himself, had been persecuted by the Sri Lankan Army (SLA) because it was apparent to the SLA that he and those family members had been involved in the LTTE.

Taking detailed instructions from our client and compiling extensive relevant information, we managed to demonstrate that Tamils in general, Tamils with perceived links to the LTTE, Tamils previously resident in previously-LTTE-controlled areas of Sri Lanka, and Tamils who return to Sri Lanka are at risk of persecution by the Sri Lankan authorities.

The reviewer accepted that the threat of harm feared by our client is the Sri Lankan state and their agents, and was satisfied that the threat of harm is one our client would face throughout Sri Lanka.

Our client’s refugee claim was accepted and he was granted a protection visa. He is one of many Tamils from Sri Lanka who our firm has represented successfully.
